Brown University Divest

On December 2nd, 2019, the Advisory Committee on Corporate Responsibility in Investment Policies (ACCRIP) voted in favor of divestment from companies “facilitating human rights violations in Palestine.” The committee voted six in favor, with two alumni voting no, and one abstaining from the vote.

The vote comes after eight months of deliberation, starting in April 2019, when 69 percent of voters in a Brown undergraduate referendum voted in favor of the same motion. In response to Brown University President Christina Paxson’s dismissal of student concerns the day following the vote, over 100 faculty members authored a letter in favor of the student referendum. Since then, members of Brown Divest have presented to ACCRIP on multiple occasions, as have Brown Students for Israel.

On December 2nd, nine members of ACCRIP met at Brown University, and heard presentations from faculty opposed to divestment, as well as those in favor. After the presentations, a motion was put forth to vote on whether the Israeli occupation of Palestinian territories constitutes social harm. Seven members voted yes, while two alumni abstained. At the end of the meeting, members of the committee motioned to vote on the following language:

We recommend that the Brown Corporation exclude from Brown’s direct investments, and require Brown’s separate account investment managers to exclude from their direct investments, companies identified as facilitating human rights violations in Palestine. In addition, the Investment Office will share with all investment managers the University’s desire to adhere to this investment philosophy. We recommend that the Corporation and Brown’s separate account investment managers maintain the withdrawal of investments from said companies until they cease to engage in social harm…

Times of Israel: The UN Human Rights Council on Wednesday published a “database” of 112 companies it says are conducting business in West Bank settlements.

In the report the council said the companies’ activities “raised particular human rights concerns.”

The list is dominated by Israeli companies, including banks and construction firms. But it also lists a number of international firms, including travel companies Airbnb, Expedia and TripAdvisor, tech giant Motorola and construction and infrastructure companies including France’s Egis Rail and British company JC Bamford Excavators.

Six of the companies listed are based in the US, four in the Netherlands, three in the UK, three in France, and one each in Luxembourg and Thailand.

Israeli authorities reacted with fury to the report, which they described as a “blacklist,” while the Palestinians lauded the list as “a victory for international law.”

The list includes companies that are directly engaged in the West Bank, parent companies that own a majority share in firms operating in the West Bank, and companies granting franchises or licenses to West Bank businesses.

UK Supreme Court Reverses BDS Ban

A major decision by the UK Supreme Court protects the rights of organizations, including government organizations, to boycott, divest and sanction the State of Israel, even companies that support the exploitation of Palestine. In 2016, the British government issued severe guidelines banning government organizations and even local governments from participating in the BDS movement in any way.

Now this has impacted the Local Government Pension Scheme, the LGPS, which were obligated to invest the pension money of public service workers in companies that violate international law. Now, that decision was met in Britain with some resistance. Channel four of the BBC spoke with Rafeef Ziadah from the Palestine Society at SOAS University.....

Excellent result but as I thought not really a progressive move forward in law but merely an affirmation of the rights of private capital to invest their money as they see fit.

Ben Jamal: So as I said, we made the argument and the thrust of our campaign obviously was the ethical position, but we had to fight it. And the reason we took the cases, we were advised that we had good legal grounds and that the most likely chance of success was the government didn’t have the power. There’s a principle in UK law relies on a Latin phrase called ultra vires. It means you’re acting outside the boundaries of the powers you have. So the argument that was used in that one was the pension regulations, the pension law to which the government attached these regulations puts obligations upon pension companies to make decisions that are always in the benefit of their members to enhance proper investment decisions, et cetera. And the argument in that one was the government did not have the right to attach conditions to how they invest money.

That had nothing to do with any of those considerations. I thought they were to do with foreign policy positions. So that’s the basis on which we won. So it’s a very important victory. Obviously the legal principle was narrow, but as a line in the sand against the government attempts to introduce anti-bias law is very important. But we do have another battle on our hands because the government in the recent Queen’s Speech, so that’s the statement that a new government makes when it’s elected, about what laws it intends to bring in over the next parliament over the next five years. The government has announced that intends to introduce another law that would ban all public bodies from supporting BDS campaign. So we know I have to take the fuel from this victory and build the coalition, which we’re in the process of doing to oppose the next law that the government is trying to bring in.

European Court of Human Rights rules in favour of BDS in France

The European Court of Human Rights ruled unanimously on Thursday that the highest appeals court in France had the violated the rights of activists with the Boycott, Divestment and Sanctions (BDS) movement when it upheld their criminal convictions in 2015.

The ruling judged that the activists, part of the nonviolent movement advocating boycotts of Israeli goods, had their rights to freedom of expression contravened under Article 10 of the European Convention on Human rights

“This momentous court ruling is a decisive victory for freedom of expression, for human rights defenders, and for the BDS movement for Palestinian freedom, justice and equality,” Rita Ahmad from the Palestinian-led BDS movement said in a statement.

The judgement marks a major victory for the BDS movement, not only in France, but for those defending Palestinian human rights across the world.

The timing of the ruling could not have come at a more important moment, as the Israeli regime seeks to annex large sections of land across West Bank....

There will be a march against Israel's annexation plan in Montréal this Sunday 9 August, starting off from métro Jarry (Trudeau's riding office was across the street from there; don't know whether it still is). At 14h/2 p.m. I don't know where it is winding up - it would be a long march to downtown. I'll try to find out.

Please inform us if similar marches or other events are planned in other cities. Of course we must be careful not to cause scheduling conflicts with Lebanese events, whether mourning or activist, in the wake of the Beirut horror.

In an order released today, Judge Mark Cohen ruled that the University System of Georgiaviolated journalist and filmmaker Abby Martin's constitutional rights when it cancelled her speaking engagement on a college campus because she refused to sign a state-mandated oath pledging not to engage in boycotts of Israel. Martin is a well-known advocate of the Boycott, Divestment, and Sanctions (BDS) movement against Israel, which the court ruled is protected by the First Amendment.

More than 20 acts withdraw from Sydney Festival to protest Israeli embassy funding

Israel is listed as a "Star Partner" of the festival thanks to its $20,000 grant in support of "Decadance", a show based on work by Israeli choreographer Ohad Naharin and Tel Aviv's Batsheva Dance Company.

At least 23 acts were confirmed to have withdrawn from the festival on Thursday after the board of the event said it had spoken with entertainers concerned over the sponsorship, but that "all funding agreements for the current Festival - including for Decadance - will be honoured, and the performances will proceed".

The announcement had elicited condemnation from several high-profile entertainers who were set to take part in one of Australia's most anticipated cultural events.

The acclaimed play Seven Methods Of Killing Kylie Jenner pulled their show on Tuesday, saying in a statement that they "stand in solidarity with the Palestinian cause".

The creative company behind the play referred to Israel as "another oppressive settler-colony" and also slammed the festival board for "ignoring" the concerns of Palestinian artists: 

"The festival's board ignored artists when concerns first arose, once again forcing people of colour to put their voices, careers and fiscal well-being on the line. Palestinian artists should have been listened to from the very start, instead of being patronised by articles and emails dismissing their pleas for divestment, they should never have had to wait in anticipation for meetings and statements to see if their colleagues were going to validate their existence."

Australian comedian Tom Ballard, who also pulled out of the event, said on Twitter: "I love the Festival and I love telling jokes, but standing up for human rights and standing against a system of apartheid is more important.".....

Hollywood stars back Emma Watson after Palestinian solidarity post

Major figures from the world of film, including Susan Sarandon, Mark Ruffalo, Peter Capaldi and Charles Dance have issued a statement in support of Emma Watson and Palestinian solidarity.

Last week, Watson, best known for playing Hermione Granger in the Harry Potter franchise, was accused of antisemitism after she posted an image on Instagram showing a photograph of a pro-Palestinian protest with the banner “solidarity is a verb” written across it. It was accompanied with a quote about the meaning of solidarity from the intersectional feminist scholar Sara Ahmed.

The post drew strong criticism from Israeli officials, including Danny Danon, a former science minister in Benjamin Netanyahu’s government and Israeli ambassador to the United Nations, who said: “Ten points from Gryffindor for being an antisemite.”

A mischief charge for a rabbi that followed a paint-dumping protest at the Israeli consulate has been dropped

A criminal charge against a Hamilton, Ont. rabbi who allegedly dumped red paint on the steps of the building housing Israel’s Toronto consulate has been withdrawn.

On Jan. 19, the Crown dropped a charge of one count of mischief under $5,000 against Rabbi David Mivasair for pouring paint on the steps of 2 Bloor St. E. to symbolize Palestinian bloodshed in last May’s 11-day Israel-Gaza war.

Mivasair, 69, was charged on May 21 after police responded to a call about damage to the consulate. His arrest stemmed from a demonstration the day before to protest Israel’s actions in Gaza.

At the time, Mivasair told media that the “violence by Israel across Palestine cannot be washed away.

“Red paint streaming from the Israeli consulate onto the street in Toronto represents the blood of massacred innocent Palestinian civilians,” he said.....

Under Investigation: Anti-Palestinian racism at the Toronto District School Board

A Black student is suspended from school for saying the words “Free Palestine” during morning announcements. A book that includes journal entries of Palestinian children is banned from school libraries. An educator sharing anti-oppression resources on Palestine for colleagues on an opt-in basis is put under investigation and his mailout is cancelled. A student who comes to class wearing a keffiyeh—a traditional Palestinian scarf—is told to remove it or get out. Students who object to history lessons that erase Palestinian existence are told they are antisemitic.

Anti-Palestinian racism thrives at The Toronto District School Board through a regime of silencing. To say “Free Palestine” is to identify a form of settler colonial unfreedom our schools would rather not address. To say “Palestine” on its own is still a problem at the TDSB, because it suggests Palestinians have the right to name their homeland instead of using the definitions and borders imposed upon them. Supporters of Israel’s occupation of Palestininan lands have narrowed the conversation so dramatically that there’s no room, particularly in places of learning, to explore Palestinian freedom for its own sake.

I had some understanding of this when the TDSB recently invited me to speak to hundreds of its employees about anti-racism and equity. Specifically, I was asked to advise the board on “creating schools that are inclusive and where all students see themselves reflected, valued, have a sense of belonging”. I know this is impossible if Palestinian students, educators and families are punished for owning their heritage, and I said so.

A predictable backlash has followed, but I’ve also heard from many Palestinians, and from those who support their liberation struggle. They point out that so many of the people recently targeted in Toronto for boosting Palestine are not Palestinian. The penalties are too high, and the exclusion of Palestinians from spaces of influence and relative protection is overwhelming. Those who work to keep Palestinians quiet are also trying to disrupt alliances between Palestinians and other oppressed peoples. They know, as Fred Hampton of the Black Panther Party said, that solidarity is our best tool to defeat racism......

Chicago Synagogue Officially Designates Itself ‘anti-Zionist’

Tzedek Chicago was founded seven years ago, in part, to create a Jewish community free from a strong attachment to Israel. The congregation went beyond its original “non-Zionism” this week to become what is likely the first synagogue in the country to be affirmatively “anti-Zionist.”

“I’m so proud of the thoughtful way we engaged with each other in this process,” Scout Bratt, the shul’s president, said in a statement Wednesday announcing the decision. “While we knew individual members would have their own personal opinions, we ultimately treated this as a communal decision, not an ideological litmus test.”

The decision to add a statement decrying the creation of Israel as an “injustice against the Palestinian people – an injustice that continues to this day” was taken by a vote of the congregation’s 200 member families after the board unanimously endorsed it in December. Seventy-three percent of households voted in favor of the motion.....

Open letter from McGill faculty and staff

We, faculty and staff at McGill University, endorse the Undergraduate Student Union’s recent adoption of the Palestine Solidarity Policy, which campaigns for a demonstration of “leadership in matters of human rights and social justice.” Generations of students have played a central role in advocating for justice, sustainability, and anti-apartheid measures. We support the students’ right to utilize democratic channels in order to campaign for these matters that impact the entire academic community.

Far from being divisive or exceptional, we see the adoption of this policy as a continuation of a long-standing history of student leadership aimed at bringing meaningful changes to their educational arenas. We strongly believe that the Student Union must function as an independent body uncoerced by the university’s administration in order to fulfill its mandate, which includes upholding democratic processes and elections — regardless of whether or not they are agreeable to the administration, ourselves, or any other actor within or outside the university. We look forward to seeing McGill University respect the democratic results of this election and we continue to commend policies that demonstrate a commitment to human rights and social justice which will only enrich our campus.

As concerned members of the McGill community, we want to recognize the great and competent student labor behind this democratic election, and express our pride that students at McGill continue to push and challenge our university to be better.

McGill University threatens to sanction student union for anti-Israel policy; By Amanda Polese; The Suburban; Apr 6, 2022

McGill University is threatening to sanction its’ student union and prohibit it from using the school’s name after the association openly supported a pro-Palestinian policy that McGill and several Jewish groups believe is discriminatory.

The Palestine Solidarity Policy was adopted in a student referendum last month with 71.1 per cent approval from the Student’s Society of McGill University but with only 15% of students voting. The policy says that McGill will join an international campaign to boycott companies and institutions that are ‘complicit in settler-colonial apartheid against Palestinians.’

Only three days after the policy was approved, Deputy Provost Fabrice Labeau sent a public statement to the McGill community denouncing the policy, calling it ‘incompatible with the university’s values of inclusion, diversity and respect.’ "McGill University firmly denounces all forms of racism and discrimination, including antisemitism and Islamophobia," said McGill spokesperson Cynthia Lee.

McGill’s administration gave the student union a month to repeal the motion or have its’ agreement terminated with the university under the ‘Memorandum of Agreement’ which governs the relationship between the school and the union. The vote on the policy was held between March 15 and 21, in which 2,294 students voted in favour of the policy and 931 voted against it.

Lee said the policy will lead to a conflict on campus and would ‘foster a culture of ostracization and disrespect based on students’ identity, religious or political beliefs.’ Several Jewish advocacy groups also support McGill’s decision. Hillel signed a joint statement with Hasbara Fellowships Canada along with other Jewish organizations on campus to denounce the policy.

Danielle Fuchs, President of Hillel Montreal, and student at McGill said she feels hesitant wearing items on campus that make her identifiable as a Jew.

"A few of us have been publicly shamed and accused of being xenophobic, racist, or even of working for the Israeli government," said Fuchs.

Court overturns French ban on Palestine solidarity groups

Emmanuel Macron’s war against campaigners for Palestinian rights suffered another big setback on Friday.

The Conseil d’Etat, which acts as France’s supreme court ruling on government actions, suspended the president’s order banning two Palestine solidarity groups.

The court upheld the right to call for a boycott of Israeli goods and found the government’s accusations of “anti-Semitism” against the two groups to be unfounded.

In February, on Macron’s instructions, interior minister Gérald Darmanin ordered the dissolution of Collectif Palestine Vaincra (Palestine Will Win Collective) and Comité Palestine Action (Palestine Action Committee).

The government accused the two groups of inciting hatred and violence in relation to Israel.

In a summary of its rulings, the Conseil d’Etat said it suspended the government orders after finding no evidence “that the positions taken by these groups, although clear-cut and even virulent, constitute a call for discrimination, hatred or violence or a provocation to commit acts of terrorism.”

With respect to Comité Palestine Action, the court ruled that the government’s order was “a serious and manifestly illegal violation of the freedom of association and freedom of expression.”......

In Support of Boycott, Divest, Sanction and a Free Palestine

When oppression strikes anywhere in the world, resistance movements reverberate globally. The desire for rightful justice spreads, like wildfire, moving us to act, to speak, to write, and right our past wrongs.

Over the past year, the Harvard College Palestine Solidarity Committee has strived to do just that. Amid escalating tensions between Israel and Palestine, PSC has hosted informational programming, organized weekly demonstrations of support through “Keffiyeh Thursdays,” and even installed a colorful, multi-panel “Wall of Resistance” in favor of Palestinian freedom and sovereignty.

In at least one regard, PSC’s spirited activism has proven successful: It has forced our campus — and our editorial board — to once again wrestle with what both Human Rights Watch and Amnesty International have called Israel’s “crimes against humanity” in the region......

Ottawa students walk out of class in support of Palestinian people

Hundreds of students walked out of class Wednesday morning at a Catholic high school in Gloucester to protest what they described as discrimination against the Palestinian people.

More than 300 students left their classes at St. Francis Xavier High School at 9:25 a.m.

"The Catholic school board are showing no attention to Palestine through this whole crisis," said Anas Arif, a student who was involved in the rally. "They have shown attention to other causes, but when it comes to Palestine, it’s a gray area."

Students from Grades 9 to 12 walked out during the school’s first period. 

"I’m here because I support Palestine fully," said Jenna Mustapha, a Grade 11 student. "I think it’s really good for us as a school to be protesting because they don’t really get a lot of air, like nobody really knows what’s going on in Palestine.”

The group marched down Limebank Road to Earl Armstrong Road, carrying flags and a banner.....

How Unions Are Backing BDS

Major unions and labor federations in Oregon recently passed unprecedented resolutions calling for divestment from an Israeli company over its human rights abuses.

In March, both the American Federation of Labor and Congress of Industrial Organizations (AFL-CIO) and the American Federation of State, County and Municipal Employees (AFSCME), collectively representing more than 300,000 workers in the state, passed a resolution calling for the state of Oregon to divest from the fund that owns Israeli spyware firm NSO. The resolution also calls on the state to implement a human rights screening for all future investments.

And just weeks ago, the Oregon Education Association, representing more than 40,000 teachers, passed a similar resolution at its convention.

The passing of these resolutions comes after multiple investigations revealed a shocking record of human rights abuses committed by governments around the world using NSO’s controversial Pegasus spyware. Following these investigations, the NSO Group was blacklisted by the Biden administration’s commerce department.

Increasing Solidarity

The state of Oregon’s public pension fund is one of the largest investors in Novalpina Capital, the private equity firm which acquired NSO in 2019 – a move that the Guardian recently revealed was tacitly approved by Oregon state officials.

This isn’t the first time that Oregon’s state pension fund, valued at $100-billion earlier this year, has come under pressure. Local activists have been pushing for divestment from fossil fuels and private prisons.

But state treasury officials have repeatedly claimed that they are unable to divest because it would “put political or social goals first.” However, those claims seem to be optional and based on perceived “enemies” of the US.

In March, state treasurer Tobias Read said that he would look into divesting from Russian holdings because “we support the people of Ukraine.”

This implies that companies such as NSO, which was recently deemed “valueless” to private equity backers, are otherwise financially sound investments for the state.

Teachers Support BDS

But as state lawmakers try to hinder human rights and climate divestment actions, labor is pushing ahead. And their divestment resolutions reflect workers’ increasing solidarity with Palestinians.

In 2021, teachers’ unions in San Francisco, Seattle and Portland passed resolutions in support of the boycott, divestment and sanctions (BDS) campaign for the first time in the US.

The NSO divestment resolution moved by the Oregon Education Association was written by a teacher from the Parkrose Faculty Association – the Portland union which unanimously endorsed BDS last year.

Parkrose teachers held educational sessions for students and staff on BDS and Palestine during Israel’s attacks on Gaza in May 2021, and carried out the vote on BDS a few weeks later.

As an athletics coach at Parkrose, I spoke at an educational session and helped craft the language for the resolution, much of which was adopted from the San Francisco teachers’ successful resolution.

The passage of the Oregon Education Association’s NSO resolution was the logical next step for the Parkrose teachers to put their solidarity into action. And the major labor unions followed suit.

The language of the AFL-CIO/AFSCME resolution calls on the unions to urge the state treasurer and the Oregon investment council to divest from “all funds managed or formerly managed by Novalpina Capital,” including the NSO fund managed by Novalpina’s owner, the consulting firm Berkeley Research Group.

Meanwhile, the unions’ calls for the implementation of an investment screening for all state investments – and annual transparency on those investments – are significant for future BDS campaigning.....
